TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "You") and the developers of Incursia ("We", "Us", or "The Service"). By inviting, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue the use of the Service and remove it from your servers. You also acknowledge that this Service operates on the Discord platform and agree to strictly adhere to Discord’s Terms of Service and Community Guidelines.

2. ELIGIBILITY

To use the Service, you must meet the minimum age requirements to create a Discord account in your country of residence (typically 13 years or older). The Service is not intended for children under the age of 13. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. INTELLECTUAL PROPERTY & FAN PROJECT DISCLAIMER

• 3.1. Proprietary Rights: The code, database structure, original artwork (excluding third-party IP), and game mechanics are the property of the Developers.
• 3.2. Third-Party IP (Marvel): This Service is a fan-made project and is not affiliated, endorsed, or sponsored by Marvel Entertainment, Disney, or their subsidiaries. All character names, images, and related indicia are the intellectual property of their respective owners. No challenge to their ownership is intended.

4. VIRTUAL GOODS AND CURRENCY

• 4.1. No Ownership: The Service may include virtual items, characters, experience points, and currency ("Virtual Goods"). You agree that you have no ownership or property interest in any Virtual Goods associated with your account.
• 4.2. Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to use these Virtual Goods solely for personal entertainment within the Service.
• 4.3. Modification and Data Wipes: We reserve the absolute right to manage, regulate, control, modify, or eliminate Virtual Goods at any time. We may wipe, reset, or alter user data (including inventories, balances, and rank history) at any time, for any reason, without notice or liability to you. This includes, but is not limited to, resets for game balancing, new seasons, bug fixes, or beta testing phases.

5. USER CONDUCT AND PROHIBITED ACTIVITIES

You agree not to engage in any of the following prohibited activities. Violation of these rules may result in a temporary or permanent ban, and/or a reset of your account data.

• 5.1. Automation and Macros: The use of user-bots, self-bots, macros, auto-clickers, scripts, or any hardware/software that automates interactions with the Service is strictly prohibited. All commands must be executed manually by a human.
• 5.2. Exploits and Glitches: You must not exploit bugs, glitches, or vulnerabilities in the Service to gain an unfair advantage. If you discover a bug, you must report it to the Developers immediately and cease using it.
• 5.3. Alt-Farming: You may not use alternative accounts ("alts") for the purpose of farming resources, bypassing cooldowns, or funneling Virtual Goods to a main account.
• 5.4. Cross-Trading: Trading Virtual Goods from this Service in exchange for goods, currency, or services in other Discord bots or games is prohibited.
• 5.5. Spam and Disruption: You may not intentionally spam commands or take actions that cause excessive load on the Service’s infrastructure or disrupt the experience for others.

6. REAL MONEY TRADING (RMT) POLICY

To preserve the integrity of the game and comply with intellectual property laws:

• 6.1. Buying, selling, or trading accounts, Virtual Goods, or currency for real-world money (fiat), cryptocurrency, or tangible assets is strictly prohibited.
• 6.2. Trading Virtual Goods for Discord Nitro, server boosts, or other external digital services is prohibited.
• 6.3. Any account found to be involved in RMT—either as a buyer or a seller—will be permanently banned, and all associated data will be deleted.

7. PURCHASES AND REFUNDS

If the Service offers optional premium subscriptions or currency purchases (e.g., via Patreon or Stripe):

• 7.1. Finality: All purchases are final and non-refundable, except where required by law.
• 7.2. Forfeiture: If your account is banned or suspended for violating these Terms, you forfeit any remaining subscription time or premium currency. No refunds will be issued in such cases.
• 7.3. Chargebacks: Initiating a payment dispute or chargeback without contacting support first will result in an immediate and permanent ban.

8. DISCLAIMER OF WARRANTIES

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, the Developers disclaim all warranties, express or implied, regarding the Service, including but not limited to fitness for a particular purpose, uptime, data security, and accuracy. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9. LIMITATION OF LIABILITY

In no event shall the Developers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data (Virtual Goods), loss of goodwill, or service interruptions, arising out of or in connection with your use of the Service.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Developers from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

11. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. We will attempt to provide reasonable notice of any major changes (e.g., via a bot announcement or support server). Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
